ITC Terminated Its Section 337 Investigation Of BOE, Which Involved Active Matrix OLED Display Devices

The United States International Trade Commission (ITC) issued a section 337 final ruling on certain active matrix OLED display devices and their components. The administrative judge of this case made a preliminary ruling on October 4, 2021 without a review, that is, based on the settlement, the investigation of the listed defendants BOE Technology Group Co.,Ltd., Beijing BOE Display Technology Co.,Ltd., and BOE Technology America was terminated.


On September 16, 2021, THE United States International Trade Commission (ITC) issued a final ruling: The administrative judge of this case made a preliminary ruling on August 20, 2021, terminating the investigation against listed defendants BOE Technology Group Co.,Ltd., BOE Display Technology Co.,Ltd., and BOE Technology America based on the settlement. No interested parties objected. The ITC decides to review the preliminary award, after which it will return the preliminary award to the Administrative Judge and require the applicant to provide an appropriately edited copy of the supplementary Agreement and/or sufficient reasons for the applicant's edits.


On January 27, 2021, the U.S. International Trade Commission (ITC) voted to initiate section 337 investigation of specific ACTIVE matrix OLED display devices and their components.


On December 28, 2020, Solas OLED Ltd. Of Ireland filed an application for 337 investigation to ITC, claiming that the product exported to, imported from and sold in the United States infringed its patent right, and requested ITC to issue a limited exclusion order and injunction.
